Telia’s Claim Against Telenor is Not Time-Barred

Telia has filed a lawsuit against Telenor for damages after it was established by ESA and the Norwegian Competition Authority that Telenor abused its dominant position in the Norwegian mobile market between 2008 and 2014. Oslo Economics assists Telia and their legal advisors Kvale with competition economic analyses and calculation of economic loss. 

In December of 2024, the question of whether the claims for damages against Telenor are time-barred was brought before the District Court. The court’s ruling was issued this week and concludes that none of Telia’s claims are time-barred. 

The question the district court considered was whether the mobile operators Network Norway, Tele2, Ventelo, Phonero, TDC, and Get (now part of Telia) had knowledge of Telenor’s violation of the Competition Act and subsequent economic loss, so that they could have filed a lawsuit earlier. 

Oslo Economics prepared analyses that documented that the operators did not have access to or could not acquire such knowledge. Central to the assessment was that the operators did not have access to information that could document that mobile broadband was not part of the same relevant market as mobile telephony. Knowledge of the relevant market was a prerequisite for documenting Telenor’s violation of the Competition Act and subsequent economic loss. 

The district court’s ruling aligns with Oslo Economics’ analyses and conclusions.
